Terms of Service

1. Who can use Cloche

You must be at least 18 years old and able to enter a binding agreement. You must give accurate information, keep it current, and keep your sign-in details to yourself. You are responsible for what happens under your account.

One person or venue, one account. Do not impersonate anyone or any business.

2. What Cloche is, and is not

Cloche is a noticeboard, a search index of publicly posted hospitality jobs, and a messaging tool. It helps hospitality workers and venues find each other.

We are not an employment agency, a labour hire company, or a party to any arrangement you reach through the app. We do not employ workers, we do not vet venues or workers, and we do not verify pay rates, working conditions, qualifications, right-to-work status or the accuracy of any post. Any engagement is strictly between the worker and the venue, and both are responsible for meeting their own obligations: including under the Fair Work Act 2009 (Cth), the relevant award, and work health and safety law.

We do not promise that you will find work, find staff, or receive any reply. Check people out for yourself before you rely on them, and meet in a safe, public setting.

3. Your content

You keep ownership of what you post. You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it for the purpose of operating and promoting Cloche, for as long as you keep it on the platform.

You promise that you have the right to post what you post, and that it does not infringe anyone's rights or break any law. You are responsible for it.

4. Imported public posts

Some posts in the feed were published publicly elsewhere and are indexed here: we show the extracted job details and a link to the original. We did not write them, we do not endorse them, and we cannot vouch for their accuracy or whether the job is still open.

• Indexed posts come only from publicly accessible sources, collected without logging in to any account. We do not index private or members-only content.
• Imported posts are deleted automatically within 30 days.
• If a post is yours, you can ask us to remove it, claim it as your own listing, or exclude you from future imports entirely: no reason needed. See the Privacy Policy, section 3.
• If you import a post using the share feature, you confirm the post was publicly accessible, you are importing it for your own individual use one post at a time, and you take responsibility for any listing you choose to publish from it.
• You may not scrape, copy in bulk, resell or redistribute content from Cloche, whether imported or user-created.

5. Acceptable use

Do not use Cloche to:

• charge a worker a fee to apply for, be considered for, or be given work;
• discriminate against anyone on a ground protected by law, including in a job ad;
• harass, threaten, abuse, stalk or send unwanted sexual content to anyone;
• post work that is unpaid where the law requires payment, unsafe, or unlawful;
• post spam, scams, multi-level marketing, or anything unrelated to hospitality work;
• publish someone else's personal information without their consent;
• misrepresent your identity, your venue, your qualifications or your certifications;
• scrape, crawl, reverse-engineer, overload or attempt to gain unauthorised access to the app or its data.

6. Job posts and applications

If you post a job, the details must be accurate and lawful: including the role, the shift type, the location, and any pay you state. If you apply for a job, your profile, experience and certifications must be truthful, and you must hold any certification you claim.

Applications, expressions of interest and messages are shared with the other party so they can decide. Treat what you receive as confidential to that purpose.

7. Moderation, suspension and removal

We can remove content and suspend or close an account if we reasonably believe these terms have been broken, or to protect users or comply with the law. Where it is practical to do so, we will tell you why. You can stop using Cloche and delete your account at any time.

8. Our intellectual property

The Cloche name, logo, app, design and code are ours. Nothing in these terms gives you a right to use them beyond using the app as intended.

We respect other people's intellectual property and expect the same from you. If you believe content on Cloche (imported or user-created) infringes your copyright or other rights, email hello@cloche.au with a link to the content, a link to or copy of the original, and enough detail for us to assess it. We review notices promptly, remove or disable access to content where a claim is made out, and act against repeat infringers. Where the law of another country gives a notice procedure (such as the US DMCA), a compliant notice to the same address will be honoured.

9. Availability and changes

Cloche is provided as-is and as-available. We may change, suspend or discontinue features, and we do not guarantee uninterrupted or error-free service. We may update these terms; for significant changes we will tell you in the app, and continuing to use Cloche means you accept the update.

10. Consumer guarantees and liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability, our liability is limited to resupplying the service or paying the cost of having it resupplied.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profits, income or opportunity. In particular, we are not liable for the conduct of any user, for any engagement or non-engagement arising from Cloche, for unpaid wages, or for the accuracy of any post: including imported posts.

You agree to indemnify us for loss we suffer because you breached these terms or the law.

11. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
